Peace Officer Exemplary Service Medal Regulations

INTERPRETATION

1. The following definitions apply in these Regulations.

"Advisory Committee" means the committee established pursuant to subsection 8(1). (Conseil consultatif)

"awards committee" means an awards committee established pursuant to subsection 9(1). (comité des décorations)

"Bar" means the Bar described in section 3. (Barrette)

"exemplary service" means service characterized by good conduct, industry and efficiency that serves as a model for others. (services distingués)

"listed organization" means an organization whose name appears on the list established by the Governor General under section 4. (organisme inscrit)

"Medal" means the Peace Officer Exemplary Service Medal described in section 2. (Médaille)

"peace officer" means an individual empowered to act as a peace officer under any law of Canada or of a province. (agent de la paix)

DESCRIPTION

2. The Peace Officer Exemplary Service Medal shall consist of a circular medal, on the obverse of which shall appear a shield set on a vallary star superimposed on a maple leaf circumscribed with the words "Exemplary Service — Services distingués" and on the reverse of which shall appear Her Majesty's Cipher. The Medal shall be suspended by a ribbon featuring a band of dark blue at the outer edge, flanked by a narrower band of light blue and then a band of gold with a single wide band of green at the centre.

3. The Bar to the Medal shall consist of a plain bar with a stylized maple leaf centred.

LIST

4. The Governor General shall establish a list containing the names of the following organizations:

(a) Canada Border Services Agency;

(b) Department of Citizenship and Immigration;

(c) Department of the Environment;

(d) Department of Fisheries and Oceans;

(e) Parks Canada Agency; and

(f) on the recommendation of the Advisory Committee, any other federal, provincial or municipal organization that employs peace officers.

ELIGIBILITY FOR MEDAL AND BAR

5. Subject to section 6, a person may be awarded the Medal if the person

(a) was an employee

  1. of a listed organization, which is a federal or provincial organization, on or after September 22, 1998, or

  2. of a listed organization, which is a municipal organization, on or after August 1, 2009;

(b) has completed at least twenty years of service with one or more listed organizations during which period the person's duties included protecting the safety and security of the public in Canada, at least ten years of which have been served as a peace officer in the performance of duties involving potential risk as determined by the Advisory Committee;

(c) has had no serious disciplinary action taken against him or her during the required period of service and has none pending; and

(d) has a record of exemplary service of such a high standard as to warrant an award of the Medal.

6. (1) No period of service that has been recognized by any other long service, good conduct or efficiency decoration or medal awarded by the Crown in right of Canada shall count as service for the award of the Medal.

(2) Full-time unrecognized exemplary service in the Canadian Forces or in any other occupation eligible for award of a Medal for exemplary service may count as qualifying service.

7. A person who has been awarded the Medal is eligible to be awarded a Bar in respect of each additional ten-year period of full-time service after the twenty-year period in respect of which he or she was awarded the Medal, if the person has a record of exemplary service of such a high standard as to warrant an award.

ADVISORY COMMITTEE AND AWARDS COMMITTEES

8. (1) An Advisory Committee is established and that Committee shall be composed of

(a) a senior representative of each organization referred to in paragraphs 4(a) and (c) to (e); and

(b) for the purpose of assisting the Committee in fulfilling its mandate referred to in subsection (2), a senior representative of each of not more than three organizations referred to in paragraph 4(f), which organizations are chosen by a majority of senior representatives referred to in paragraph (a).

(2) The Advisory Committee shall advise the Governor General on such matters concerning the award of the Medal and Bar as the Governor General may refer to the Committee for consideration.

(3) The Advisory Committee shall elect a chairperson from among the members.

9. (1) There shall be established an awards committee for each listed organization.

(2) The head of each listed organization shall appoint the members of the awards committee for that organization.

(3) The Advisory Committee shall determine the manner in which the chairperson of each awards committee is chosen.

NOMINATION PROCEDURE

10. (1) Nominations for the Medal or Bar shall be submitted to the Advisory Committee by the chairperson or designated member of an awards committee for the listed organization of which the nominee is or was an employee.

(2) A nomination shall consist of a written recommendation

(a) setting out that the nominee was an employee of a listed organization on or after September 22, 1998 and the date on which he or she completed the required period of service for the Medal or Bar;

(b) stating that at least twenty years of the nominee's total service has been served in the performance of duties protecting the safety and security of the public in Canada, at least ten of which were served as a peace officer in the performance of duties involving potential risk;

(c) stating that, during the required period of service, no serious disciplinary action has been taken in respect of the nominee and that none is pending on the day on which the nomination form is signed;

(d) stating that the nominee has or had a record of exemplary service of such a high standard as to warrant an award of the Medal or Bar; and

(e) signed by the chairperson or designated member of the awards committee.

11. The Advisory Committee shall ensure that

(a) recommendations meet the requirements of subsection 10(2);

(b) the awards committees have verified the eligibility of nominations; and

(c) all documentation necessary for submitting the nominations to the Chancellery has been completed.

AWARDS

12. An award of the Medal or Bar shall be made by Instrument signed by the Governor General.

13. The Medal and Bar may be awarded posthumously.

14. Despite sections 5 and 10, an awards committee or the Advisory Committee may recommend to the Governor General an extraordinary award of the Medal, including a posthumous award if the person died in the performance of his or her duties and is not the recipient of any other award from Her Majesty in right of Canada directly related to the circumstances of his or her death.

PRESENTATION

15. Unless the Governor General otherwise directs, the Medal or Bar shall be sent to the chairperson of the appropriate awards committee or the Advisory Committee for formal presentation, on behalf of the Governor General, to the recipient.

WEARING OF MEDALS AND BARS

16. (1) The Medal and Bar shall be worn in the sequence prescribed and in the manner described in publications issued by the Chancellery.

(2) When the ribbon of the Medal is worn alone and the wearer has been awarded a Bar, a small silver maple leaf shall be attached to the centre of the ribbon.

17. A person to whom the Medal has been awarded may wear a miniature of the Medal on all occasions when the wearing of miniatures is customary.

ADMINISTRATION

18. The Director, Honours, Chancellery shall

(a) prepare the Instruments of award for signature by the Governor General;

(b) acquire the Medals and Bars and have the names of recipients engraved on the Medals;

(c) maintain a register containing the names of recipients and such other records relating to the award as the Director considers necessary;

(d) issue certificates to accompany the Medals and Bars;

(e) arrange for award ceremonies or send the Medals and Bars for presentation to the recipients in accordance with section 15; and

(f) perform such other functions in respect of awards of the Medals and Bars as the Governor General may require the Director to perform.

CANCELLATION AND REINSTATEMENT

19. (1) The Governor General may, on the advice of the Advisory Committee,

(a) cancel or annul the award of a Medal or Bar to any person; and

(b) restore the award of a Medal or Bar that has been cancelled or annulled.

(2) Where the award of a Medal is cancelled or annulled, the name of the recipient shall be deleted from the register referred to in paragraph 18(c).

GENERAL

20. Nothing in these Regulations limits the right of the Governor General to exercise all powers and authorities of the Sovereign in respect of the Medal and Bar.
