The Protection of the Canadian Heraldry Under the Trade-marks Act

Under paragraph 9(1)(n.1) of the Trade-marks Act, granted heraldic emblems are protected from misuse for commercial purposes. This applies to heraldic emblems registered as trademarks and published in the Trade-marks Journal.

On request, the Canadian Heraldic Authority can arrange for the trade-mark registration of a heraldic emblem in the Public Register of Arms, Flags and Badges of Canada. A fee of $500 per emblem (e.g. a coat of arms and flag count as two emblems) is payable to the Receiver General of Canada. The protection is valid for 15 years. Contact us for more information.
